TERMS AND CONDITIONS
LIMITATION OF LIABILITY
This section defines our responsibility with respect to all of our workshops. PLEASE READ IT CAREFULLY.
Payment of your reservation deposit(s) represents your acceptance of all terms and conditions outlined anywhere within this document. The workshop application on which your signature appears will further represent your acceptance of the following terms and conditions.
Aventura Workshops LLC shall have no liability for any damages, losses, or expenses of whatever cause or nature, including those resulting directly or indirectly from acts of God, detention, annoyance, weather, quarantines, strikes, civil disturbance, theft or criminal activity of any kind, government regulations, etc., over which it has no control.
Without limiting the above paragraph, Aventura Workshops LLC shall have no responsibility for additional expenses due to unforeseen delays caused by weather, theft or criminal activity of any kind, political disputes, acts of terrorism, strikes, sickness, failure of flights or other transportation to arrive or depart on time, and other causes beyond our control. Aventura Workshops LLC is not responsible for additional hotel nights not specified in the workshop itineraries which may be required en route, prior to or following a trip, caused by airline scheduling or schedule changes, or by individual clients’ travel arrangements or by other factors. Aventura Workshops LLC cannot assume any responsibility for loss or damage to baggage or personal property.
PRICES & SURCHARGES
Workshop registrations are accepted on a first-come, first-served basis. All Workshop pricing is in U.S. dollars. All fees may be paid with a credit card (via PayPal or Stripe) or check.
A non-refundable deposit, the amount will be specified in the Workshop information, is required at the time of your registration. Reservations for Workshops cannot be held without a deposit. Unless otherwise noted, the balance of the Workshop fee is due no later than 90 days before the Workshop start date. Should this final payment fail to process or be received by the date specified, we reserve the right to treat the reservation as canceled and retain the deposit. If a reservation is made 90 days or less before the Workshop start date, then the full amount is payable at the time of reservation.
Any type of bank fees incurred to proceed with a refund to a participant will be at the cost of you.
Aventura Workshops LLC reserves the right to impose surcharges up to 30 days before departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require Aventura Workshops LLC to do so. If any surcharge results in an increase of more than 10% of the workshop price, you may cancel your booking within 14 days of notification of the surcharge, and obtain a full refund.
The “all-inclusive” workshop cost includes the tuition fee, accommodation (single room), food, transport from the airport to the workshop location/s, and national park fees. All other expenses are the responsibility of the participants. Not included are any airfares, airport taxes, transportation to and from the meeting point, or items of a personal nature. Price also excludes any insurance coverage for trip cancellation/interruption, travel accident, travel delay, baggage delay or baggage theft, medical or hospitalization expenses.
We recommend you obtain coverage/insurance for these items. We have partnered with an insurance agency that allows you to compare policies from various providers and choose the most suitable one for your needs.
WITHDRAWAL & REFUND POLICY
All workshop withdrawal requests by the participant must be in writing and received either by US mail or e-mail and acknowledged by Aventura Workshops LLC. There are NO EXCEPTIONS TO THIS POLICY, even for medical emergencies. Payments made for private workshops that you arrange with us are not refundable regardless of when you cancel.
We strongly recommend you to get Trip Cancellation & Travel Insurance after booking your trip. If you withdraw and your place is otherwise filled, we will refund you the full amount you have paid towards the tuition, minus cancelation fee. If you withdraw and your place on the Workshop does not fill, then you will be refunded according to the following schedule, based on the full fee of the Workshop:
90 days or more: Full refund minus cancelation fee
60 - 89 days: 50% refund.
60 days or less: No refund.
Refunds will be paid by the same method that the original payment was made.
Please note: Any non-refundable fees paid to a third party in connection with your workshop cannot be refunded.
LATE ARRIVALS AND EARLY DEPARTURES
No refund will be made for any tour hours or days missed due to late arrivals or early departure by you.
It is very important that you arrive on time for the start of a tour. Any delay from a you could jeopardise the opportunity for you to join the tour. In case of a late arrival by you that we are unable to accommodate, your tour will be cancelled without refund. It is thus important to contact us if you are late to see if we can make arrangements for you to catch up with the tour. As we often operate in remote areas this is sometimes not possible.
In case of an early departure, you will bear all the costs and responsibility that it may involve (additional guides hire, transport, hotel room, etc.). If the departure is due to an illness or an accident, you will use your personal health, accident, or mountain rescue insurance to which you will have subscribed prior to the tour. If you leave the tour before its completion, you will not be able to receive any refund for the time missed.
YOUR DETAILS
For Aventura Workshops LLC to confirm your travel arrangements, you must provide all requested details upon booking. Necessary details include full name as per passport, date of birth, and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. Your booking cannot be confirmed without provision of these details.
EQUIPMENT
Aventura Workshops LLC does not provide equipment of any kind for use by Workshop participants. Workshop participants must bring their own photography gear and (if needed) a laptop computer.
INFORMATION AWARENESS
Aventura Workshops LLC provides a workshop itinerary/workshop description on the website https://www.aventura.photography/. It is your responsibility to ensure you have read and understood this information in its entirety, as well as to have undertaken your own research, to ensure you are properly prepared for the locations and experiences expected.
PASSPORT AND VISAS
For international workshops, you must carry a valid passport, and it is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for the countries which you will visit during your workshop. Your passport must be valid for six months beyond the duration of the workshop. Aventura Workshops LLC is not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
TRAVEL INSURANCE
Travel insurance is compulsory for all Aventura Workshops LLC workshop guests and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. Aventura Workshops LLC also strongly recommend it cover cancellation, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on or before the final workshop payment (90 days before departure); you will not be able to join the trip without it.
THIRD-PARTY PROVIDERS
You understand that we rely upon third-party organizers, transportation providers, hotel operators, and food providers to provide the services associated with the Workshops. All tickets, coupons, reservations, etc. are subject to the terms and conditions and other policies of the third-party service provider. We cannot control the actions of such third parties and do not assume responsibility for unanticipated events that may occur, including, without limitation, travel delays, lost luggage, cancellations, overbooking, and other reservation errors. You should build some flexibility into your schedule in case we need to extend the length of the Workshop or make other reasonable scheduling changes to accommodate unanticipated events such as travel delays, lost luggage, cancellations, overbooking, and other reservation errors. You will not be entitled to a refund in the event of unanticipated events requiring scheduling changes. You further agree to hold us harmless from and against any liability for injury, death, damage, loss, accident, delay, or irregularity that might occur in connection with any services provided by third parties.
CHANGE OF ITINERARY
While Aventura Workshops LLC endeavors to operate all workshops as described, Aventura Workshops LLC reserves the right to change the itinerary at any time without prior notice.
Before departure: If Aventura Workshops LLC makes a major change to the itinerary (one that affects more than 20% of the workshop days) you will be informed as soon as reasonably possible. If a major change is made, you may choose between accepting the change, or canceling your booking and obtaining a refund of all money you paid to Aventura Workshops LLC for that workshop or you have the option of receiving a credit in the amount of the Workshop fee that may be applied in full to pay for a future Workshop to be used within 24 months of the original Workshop you are registered to participate in. Aventura Workshops LLC cannot be responsible for any travel expenses or non-refundable purchases, deposits, or reservations. It is recommended that you purchase trip insurance.
Notification of cancellation will be made via either a telephone call or an email to you. We cannot be responsible for voicemail messages and e-mails not being received in a timely manner due to your service provider(s).
After departure: Aventura Workshops LLC reserves the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you, if requested. There will be no refunds offered due to necessary itinerary changes forced upon us by factors outside Aventura Workshops LLC control, nor will Aventura Workshops LLC be responsible for any incidental expenses that may be incurred as a result.
INSTRUCTOR SUBSTITUTION
In the event of the specified instructor being unable to attend due to illness or other circumstances beyond our control, another instructor will be provided if possible. If we need to replace an instructor, we will do so with someone of equal or similar credentials and will inform you if at all possible.
AGE AND FITNESS REQUIREMENTS
For the majority of our workshops the minimum age is 18 at the time of travel. The majority of Aventura Workshops LLC workshops have no upper age limit, though you are reminded that some workshops can be physically demanding – refer to each workshop's itinerary and ‘physical activity’ level to determine your suitability.
Our workshops may be taken by anyone in good physical condition. As you will have to go up and down stairways, walk over irregular terrain, and carry equipment, you are encouraged to get in shape by exercising regularly. Please contact us if you have any questions about your ability to do a particular trip. Once a trip has started and it is necessary for you to leave the trip because it is beyond your physical level, please note that there will be no refunds for any unused portion of the trip.
Aventura Workshops LLC reserves the right to decline bookings at its sole discretion if it feels you may be unsuited to the level of activity required. Aventura Workshops LLC is unable to provide specific mandatory health requirements, and it is your responsibility to ensure that you obtain proper and detailed medical advice requirements and recommendations for your destination at least two months prior to travel. Where you do not do so and either are not allowed to enter any country, or suffer personal injury or death as a result, Aventura Workshops LLC has no liability to you for any cost, loss or damage which you suffer nor will Aventura Workshops LLC refund you the cost of any unused portion of your travel arrangements.
MEDICAL
You must be in generally good health and it is vital that persons with medical problems make them known to us well before the workshop begins. It is understood that Aventura Workshops LLC is not a medical facility and therefore has no expertise or responsibility regarding what medications or vaccinations you and your private physician should decide necessary for your safe participation in the workshop. Aventura Workshops LLC assumes no liability regarding provision of medical care. Trip members are urged to check their coverage to be sure it is adequate.
USE OF NAME AND LIKENESS
We reserve the right to take photographs or videos during the operation of any Workshop or part thereof and to use the resulting photography in whole or in part for promotional purposes, including, but not limited to: advertising and publicity both in print and electronic media. By booking a reservation with Aventura Workshops LLC, participants agree to allow their images to be used in such photography; participants who prefer that their image not be used are asked to identify themselves to their workshop leader at the commencement of their trip. We also reserve the right to use, in all or in part, any written reviews you may provide to us in our advertising and publicity, both in print and electronic media.
SUBSTANCE-FREE ENVIRONMENT
The possession and use of alcohol and illegal drugs and the use of smoking and e-cigarette and other vapor products are prohibited in any of the classrooms, meal areas, or rooms used by Aventura Workshops LLC or at any field Workshop location.
ACCEPTANCE OF TERMS & CONDITIONS
By paying the Workshop deposit, you agree to accept all the above terms & conditions.
